Terms & Conditions – Art Deco Napier Subscription Prize Draw

1. Eligibility

• The prize draw is open to individuals aged 18 years or over.
• Employees of the Art Deco Trust, their immediate families, and associated agencies are not eligible to enter.

2. How to Enter

• To enter, subscribe to the Art Deco Napier mailing list using the official subscription form, available on the Art Deco Napier website (www.artdeconapier.com), by 11:59 pm NZT on Friday, 28 February 2025.
• No purchase is necessary to enter.
• Only one entry per person is permitted. Duplicate entries will be disqualified.

3. Prizes

• Prizes include, for example, Art Deco Festival Napier 2025 event tickets. Specific prize details are subject to availability and may be amended at the discretion of the Art Deco Trust.
• Prizes are non-transferable and cannot be exchanged for cash or other alternatives.
• Winners are responsible for any additional costs not explicitly included in the prize (e.g., travel or accommodation unless specified).

4. Winner Selection

• Winners will be randomly drawn at intervals during the campaign using a verifiable random selection method (e.g., a Python script).
• Winners will be notified via email within 5 business days of the draw.
• If a winner cannot be contacted or does not respond within 5 business days of the notification being sent, the prize will be forfeited, and a new winner will be drawn using the same method.
• All reasonable efforts, including follow-up emails, will be made to contact the winner.
• The decision of the Art Deco Trust regarding the winner selection process is final and binding. No correspondence will be entered into.

5. Use of Personal Information

• By entering the draw, participants consent to the collection and use of their personal information for the purposes of administering the competition and subscribing to the Art Deco Napier mailing list.
• Personal information will be managed in accordance with the Art Deco Trust’s Privacy Policy, available at [https://www.artdeconapier.com/terms-conditions/].

6. Liability

• The Art Deco Trust accepts no responsibility for entries that are lost, delayed, or incomplete due to technical errors.
• The Art Deco Trust is not liable for any injuries, losses, or damages resulting from participation in the competition or use of the prizes.
• Nothing in these terms limits or excludes liability for matters that cannot be lawfully excluded under New Zealand law.

7. General Conditions

• By entering, participants agree to be bound by these Terms & Conditions.
• The Art Deco Trust reserves the right to cancel or amend the prize draw or these Terms & Conditions at any time without prior notice.
• These Terms & Conditions are governed by the laws of New Zealand. Any disputes will be resolved in accordance with New Zealand law.

8. Public Announcement Clause

• By entering the prize draw, participants agree that their first name and location (e.g., “Jane from Rotorua”) may be announced publicly as winners on Art Deco Napier’s social media channels, website, and email communications.
• Winners will not be required to pay any fees to claim their prize. Any request for payment should be reported to the Art Deco Trust immediately.

9. Photo Consent Clause

• Winners may be asked to have a photo taken of themselves enjoying their prize or during their experience. Providing such a photo is optional and does not affect the winner’s right to claim the prize.
• By agreeing to have their photo taken, winners grant permission for Art Deco Napier to use these images for promotional purposes, including but not limited to social media, email newsletters, and the website.

10. Opt-Out Option

• Participants who do not wish for their name or photo to be used in the ways described above must notify Art Deco Napier in writing within 5 days of being contacted as the winner.
